Terms of Service

1. Who We Are

Hromada Inc. (“Hromada,” “we,” “us”) is a Maryland nonprofit corporation with its principal office at 501 New Mark Esplanade, Rockville, MD 20850 (EIN 41-5028677). Hromada has applied to the Internal Revenue Service for recognition of exemption under Section 501(c)(3) of the Internal Revenue Code. That application is pending. Hromada operates the website at hromadaproject.org (the “Platform”). By using the Platform or contributing to Hromada, you agree to these Terms.

2. What the Platform Does

The Platform publishes civilian infrastructure projects requested by Ukrainian municipalities and identified, documented, and verified by Ukrainian non-governmental organizations that Hromada’s Board of Directors has recognized as partners. Project descriptions, cost estimates, photographs, and progress reports are supplied by those partners and municipalities. Hromada reviews each project before publication as described on our Transparency page, but estimates may change and Hromada does not guarantee that any project will proceed on the timeline or at the cost published.

3. Contributions

Who may contribute

Hromada accepts charitable contributions only from donors based in the United States.

What a contribution consists of

Each project is published at its full cost. The contribution designated for a project equals the published project cost plus an operating allocation of five percent (5%) of that cost. Hromada grants the full published project cost to the municipality and retains the operating allocation to fund its operating costs. The allocation rate is set by Hromada’s Board of Directors, reviewed at least annually, and disclosed to you before you contribute. Any change applies only to contributions made after the change is published.

Hromada’s discretion and control

Every contribution is a gift to Hromada Inc. When you designate a published project, that designation is a preference and is not binding. Hromada’s Board of Directors retains full discretion and control over the use of all contributions, including whether, when, and in what amount to make any grant. Hromada makes grants only in furtherance of its own charitable purposes and only to recipients that have completed its pre-grant review and sanctions screening.

If a project cannot proceed

If a designated project cannot proceed as published, because verification fails, the scope changes, sanctions screening raises a concern, or for any other reason, Hromada may hold your contribution pending resolution, apply it to another qualifying project that advances substantially the same charitable purpose, or return it. Hromada will notify you in writing before applying your contribution to a different project. The choice among these options rests with Hromada.

Acknowledgments and tax treatment

Hromada will provide a written acknowledgment for each contribution. No goods or services are provided in exchange for contributions. Because Hromada’s application for recognition under Section 501(c)(3) is pending, contributions are not yet confirmed as tax-deductible. If the application is approved, contributions made on or after March 21, 2026 will be deductible retroactively to the extent permitted by law. Hromada does not provide tax advice; consult your own adviser.

How contributions are made

Contributions are made by bank transfer, by check, or through a donor-advised fund, using the instructions Hromada provides after you contact us about a project. Hromada does not process card payments on the Platform. Hromada does not accept contributions that would violate United States sanctions laws.

4. Accounts and the Donor Dashboard

If you create an account, you are responsible for the accuracy of the information you provide and for keeping your login credentials confidential. The donor dashboard displays the status of grants funded by your contributions based on reports Hromada receives from municipalities and partner organizations. Hromada may suspend or close an account that is used in violation of these Terms.

5. Partner Submissions

Only partner organizations recognized by Hromada’s Board may submit projects. A partner that submits a project represents that the information is accurate to the best of its knowledge, that it has the municipality’s authorization to submit the project, and that it has obtained the consents required under applicable law for any photographs or personal data included.

6. Intellectual Property

The Platform, its design, its text, and the Hromada name and logo are owned by or licensed to Hromada Inc. Project materials supplied by partners and municipalities are published with their permission for the purpose of presenting the projects. You may view and share Platform content for personal, non-commercial purposes with attribution to Hromada. Any other use requires written permission.

7. Acceptable Use

You agree not to use the Platform to submit false information, to interfere with its operation, to attempt unauthorized access to any account or system, or for any purpose that is unlawful or that violates these Terms.

8. Third-Party Links

The Platform links to third-party sites, including Prozorro, Ukraine’s public procurement system, and partner organizations’ websites. Hromada does not control and is not responsible for their content.

9. Disclaimers and Limitation of Liability

The Platform is provided “as is.” Hromada makes no warranty, express or implied, regarding the Platform or the outcome of any project. To the fullest extent permitted by law, Hromada Inc. and its directors, officers, volunteers, and partners are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform or your contribution. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Platform shall be brought in the state or federal courts located in Montgomery County, Maryland.

11. Changes to These Terms

Hromada may update these Terms from time to time. The effective date above shows the current version. Changes apply to contributions made and Platform use occurring after the updated Terms are published.
